I would like to tell you about the Beckett’s play we watched this weekend – the one I had to rush to right after sending the Ztampfever No. 31. But I’m troubled. My heart is heavy…

Two days ago I received several emails from fellow designers: several of my works have been illegally shared through a certain file sharing site. Yes, it has happened before in the past, but never this many and mostly were my free samplers. This time, it is my paid-for kits that are being illegally shared. Some of them are from my beloved The Great Expectations Collection too. It is a pregnancy and baby kit. Just think what kind of people these must be! Imagine… These shameless women (and mothers at that too) scrap about their pregnancy and children using stolen goods. Stolen from hardworking individuals like me. We designers are not big corporations who exploit their workers – or anything like that – whom some people might think deserved to be pirated. We work on our own from home, using our own creativity and skills to create our products to generate independent income to help paying rents and utility bills. And these thieves are stealing from us… It can’t be out of innocent ignorance either. I understand that some people might have unwittingly shared a few kits with their family and friends, perhaps because they don’t know the basics of copyright as it applies to digital files. I harbor no hard feeling towards these people. What I have found instead is that they have removed my Terms Of Use file included in each download folder so other people won’t be able to read it. And they uploaded the files to a file sharing site and share the links through illegal file sharing groups. This is not a generous sharing between genuine friends. This is a massive illegal sharing. This is not just a shameless act. This is intentional malice.

What breaks my heart even more is that… this must have been done by at least one of my own customers… My guts feeling told me that they are not my regular customers, though. Probably they got my kits for free or at huge discounted pricing through some Sale/Promotional Events or some random prizes given during Ztampf! 2nd Birthday Party (the Scavenger Hunt). Whoever they are, I hope they will receive their karma accordingly. Soon.

I love giving away Gift Certificates, Huge Discount Coupons and even Freebies. However, experience has taught me that these things often attract those pirates whose goal is to get scrap kits for free or at lowest possible cost, only to illegally share them later… They are so petty to take delight in easy stealing of other women’s hard work – I guess they have no self-respect nor dignity. I do feel sorry for them – they probably have nothing to be proud of or to be happy for that they have to derive pleasure and to win friends by sharing files illegally. By making Thieves of themselves. But I also feel so violated and angry. What a waste of my otherwise productive time.

Anyway. I have reported the illegal links to the file sharing company. Many other designers who are also the victim of this piracy have also submitted their reports. This statement below can be found on the front page of my shop. But let me put it up here as a reminder:

I would like to take this opportunity to thank my honest customers… Customers with integrity who don’t redistribute their purchase, who asked about (and purchased) the Professional Use Licenses, and who have been supportive to me and Ztampf! Thank you from the bottom of my heart for your integrity and ongoing support. Without you, Ztampf! wouldn’t have lasted.

I encourage you to inform the designer(s) if you know that their products are being illegally shared/redistributed. Please help educate your friends who are new to digital scrapbooking about the basics of copyright too. All products are copyrighted by the original designer/artist. By purchasing and downloading a digital product, what they are getting is the personal license to use the product as outlined in the Terms Of Use file included in each downloaded folder. They do not in any way own the product in the sense of owning a physical product. Sharing and redistributing their purchase is a violation to the Terms Of Use and is totally prohibited. If you have any questions, please, do not hesitate to email me any time.

I’m sorry for the gloomy tone of my post this time. I just can’t help it. Thanks again for your support!

Fhung, I’m so sorry to read about this and while I’m fairly sure all your stuff that I have I’ve either purchased or downloaded from your site, how would I know if I was buying something illegal?

Oh Fhung, how awful your files were pirated!! Such blatant piracy is truly shameful & I’m so sorry for you & all the other designers who are being stolen from. I hope you were able to get all of your links removed & that a solution can be found soon to stop the piracy once & for all.

I have heard so many designers stating this has happened to them. I only hope this is a ‘wave’ and not a full fledge trend. I am sorry and don’t understand WHY someone would do this! If they are redistributing the kits free, they aren’t getting money so —- why do it at all???? I personally have never even shared with my family any files I have bought because I realize most designers are simply people earning a little (or a lot- whatever) extra cash to help their families finances. And to steal talent that way is just so very very wrong. Again, I am so sorry.
To be sure, is it okay for me to use your kit pieces to make a card and print it out – or even email a FLATTEN COPY (not the layers) jpeg or png file to someone?
I feel I should ask this – I assume it is okay, but I want to double check now. I don’t want to be contributing to this heinous crime!

Fhung: I heard about this from another designer the other day. It is so awful!!! I do hope it is someone who is ignorant, rather than just an out right Thief.

I don’t understand, do they just say it is their own work? How can they post it when their is someone else’s name on????

Usually I am very cynic about the issue. After all, I am admitting with shame, I do live in a country that is rated #2 in the world in piracy of all sort. I can tell you that where I work, I am the only one who has a legal operating system on my computer, not to mention all other software. No one here understands the value of these things to their creators. But then… you are right. Some of those creators are considered “the bad guys” from which it is “ok” to steal.

Well, I don’t believe in this. I think stealing is wrong, no matter who the victim is!!!

And yet, this time it makes me feel even sadder. First, because you are my favorite designer and I respect you personally in so many ways, that makes me feel your pain and ache so much for you.
Second, I know from first degree how your creations comes out of the innermost you. And last, because I know how generous you are. How much you want to give to your customers and the admirers of your work. And I remember all your answers to my thoughts expressed out loud, wondering if you really don’t give too much away…

But: there is a saying in Arabic, that I truly believe, and that time after time I see how it actually works: “Kul kalb bigi yumo” – Every dog – it’s day will come. Everyone who does such bad things – will see his bad coming.

So I hope you will be strong and this will not hurt your motivation to create more and even more amazing kits and other digital products.
And I hope that the love of your customers and admirers will heal the wounds of this disgusting act.

Besides… I would love to hear about the Becket’s play… ;-)

There isn’t much that I can say that hasn’t already been said. There are all kinds of people in this world–good and bad. Why do losers come up with viruses to destroy? Because they can’t create?

I have heard a little bit about what has been going on over at DST and it makes me want to crawl back under my rock. Unfortunately, this will probably not stop until someone is prosecuted for their illegal acts.

I’m not sure how they were sharing. Was it a blog leading you to a file share site? Can’t that individual be tracked and brought to justice?

One of the things that I love about digi scrapping is being able to shop and get my product instantly. This is also what makes it so dangerous for the designers. Too easy for trash to steal products.

You are also my favorite designer, and I hope that this doesn’t sour you from the honest community which, really, is the majority of people. There will always be a few bad apples, but hopefully the orchard won’t die because of them.

Cheer up please and try to focus on your upcoming trip!

Oh Fhung, I just read this. I haven’t been digiscrapping lately and I’m a bit out of the digiworld. I’m so very sorry this happened to you or any designers. Whoever is/are doing this really do not appreciate one’s hard work and you’re right these people just don’t have any dignity. You are my most favorite designer and to hear this happens to you makes my heart ache for you.

Hope you and the other designers resolve this soon.
